RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS BY AGREEING YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE PLEASE READ CAREFULLY.

ASSUMPTION OF RISKS: I understand that by virtue of my participation or involvement in any activity or programs offered by Brockman Health & Fitness (“The Grind”), that I will be exposed to risks which may include but not be limited to serious injury, including permanent disability and death, and social and economic losses. I acknowledge the existence of known risks and potential unknown risks and I voluntarily assume the risks which may include but not be limited to:

(a) EQUIPMENT: Any manner of injury, including death, resulting from use, misuse, non-use and failure of any equipment at The Grind, as well as equipment supplied by the participant.

(b) LOSS OF PERSONAL PRIVACY/IDENTITY THEFT: Any manner of injury caused by the loss of personal privacy through identity theft or unauthorized use of photographs taken of the participant by other participants or trespassers at The Grind.

(c) PHYSICAL ACTIVITY: All manner of injury arising, including death, from falling and impacting against the floor surface, walls, apparatus/equipment, and the ground; impacting with other participants or equipment; abrasions or bruises resulting from impact with other participants or equipment; an increased load on the heart, which may result in dizziness, shortness of breath and in extreme circumstances, may result in a heart attack; potential for bone and muscular skeletal injury, such as sprains and strains; episodes of light headedness, fainting, chest discomfort, leg cramps and nausea.

(d) TERRAIN: Any manner of injury, including death, resulting from falls on steps, slippery or uneven floors or other man made features whether at The Grind or while participating in activities offered by The Grind.

(e) THEFT OF PROPERTY: Any manner of property loss through theft by others, or damage to property caused by others.

(f) MINORS A rider must be a minimum of twelve years of age and accompanied by a parent or legal guardian if under the age of sixteen.

I understand that I am solely responsible for my own health, medical, dental, and property insurance. I freely accept and fully assume all risks, dangers and hazards and the possibility of personal injury, death, property damage, expense and other loss delay or inconvenience resulting therefrom or from acts or omissions, including negligence from The Grind and its directors, officers, employees, agents, volunteers and independent contractors.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT: In consideration of the Owner, the Manager or their employees, agents or volunteers allowing me to participate in the The Grind activities, I hereby agree as follows:

(a) TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the Owner, the Manager and their directors, officers, employees, agents, volunteers and independent contractors (all of whom are hereinafter collectively referred to as the “Releasees”) arising directly or indirectly from my attendance at The Grind or participation in any activities coordinated by the Releasees.

(b) TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury or expense that I may suffer or that my next of kin may suffer as a result of my participation in such activities due to any cause, including any wrongful act or omission, including NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE.

(c) THAT THIS AGREEMENT shall be effective and binding upon my heirs, next of kin, executors, administrators and assigns, in the event of my death or incapacity.

(d) THAT THE TERMS of this Release of Liability, Waiver of Claims and Assumption of Risks shall apply, and have priority over any previous agreement or written agreement, representation, term or condition to the contrary.

(e) Reservations
In order to reserve your spot, you must first create an online account and purchase spin credits or an unlimited membership.Purchased spin packages or individual spin credits are final sale and cannot be transferred from one person to another.

All classes will be made available for reservation 30 days in advance. Being released 12 noon on the final day of the previous month.

Reservations can only be made if you have a current spin package or have active individual spin credits available in your account. If you do not have any active packages or individual credits, you will need to purchase these prior to making a new reservation. *unlimited packages require advance bookings to reserve your spot*

With every class, each rider can utilize rental shoes provided by The Grind free of charge. The Grind carries rental shoe sizes between 38 to 48 (EUR). Each rider can bring their own spin shoes if they wish, but they must have SPD clips to be compatible with our indoor bikes. Spin shoes are strongly encouraged and no outside footwear allowed in the studio

The Grind reserves the right to change class instructors without notice.

Prices are subject to change at anytime by The Grind without notice.

(f) Merchandise
Unworn, unwashed and undamaged clothing may be exchanged within 7 days of original purchase. All other merchandise sales are final.

We accept cash,Visa, MasterCard and debit at the studio.

(g) Cancellations
If you need to cancel your reservation for a class, you must do so through your online account. Cancellations cannot be made via phone or email. Cancellations must occur a minimum of 8 hours prior to the start time of your reserved class. Once you have cancelled a class successfully your spin credit will be returned to your account so that you may use it towards another class.

If you do not cancel a class outside of the 8 hours prior to the class start time, your account will be deducted one credit as though you attended the class. Additionally, if you have not checked in at least 5 min prior to the scheduled class start time, your spot in the class MAY be given away to a rider on the waitlist. Please note we reserve the right to cancel any class without notice due to unforeseen circumstances.

All bookings must be managed through the website or The Grind app. We’re unable to accept booking requests via phone or email.

(h) Unlimited Packages
For our monthly unlimited spin packages, the same rules apply as above. If you do not cancel outside of the 8 hour time window prior to the start time of your reserved class, you will be charged an $10 cancellation fee to the credit card associated to your account.

(i) Waitlist
If a class you wish to attend is fully booked please feel free to join the waitlist. If a spot becomes available you’ll receive a text/email informing you of the opening, make sure you have notifications subscribed and your current phone number and email are updated on your profile. For text message notifications, respond ‘Y’ to confirm or ‘N’ to decline. If you don’t reply with a response this will be considered confirmation of attendance and ‘no-shows’ will be charged as per cancellation policy. Email notifications are also sent out upon being successfully added from the waitlist.

Please ensure you have info@thegrindhumboldt.ca added to your safe list so these notifications don’t end up in your junk folder to avoid unnecessary cancellation charges or missed opportunities.

If you aren’t prepared to attend on short notice, please remove yourself from the waitlist prior to going to sleep or prior to the penalty-free cancellation window.

(j) Return/refunds
All Spin packages are non refundable and are non transferable.

(k) Minors
Minor, under the age of 18, must fill out a liability waiver prior to first class. Minors without a signed waiver will be refused entry to class and regular cancellation policies will occur. A rider must be a minimum of 12 years of age and accompanied by a parent or legal guardian if under the age of 16.

(l) Personal Belongings
The Grind supplies lockers without locks and open cubby systems for all riders to use while attending a class. The Grind will not be responsible for the damage or loss of any personal belongings while the rider is in class.

(m) Links to 3rd Party Websites
The Grind website may contain links to 3rd party websites that are not owned or controlled by The Grind studio themselves and therefore does not accept any responsibility for the content or practices of the 3rd party websites.

Acceptance of Terms
By using The Grind website and/or booking and attending classes, you have accepted these terms and conditions laid out by The Grind and waiving legal rights to sure for damages which I or my my heirs, next of kin, executors, administrators and assigns may have against the releasess.
